MongChi Terms of Service

These terms govern your use of MongChi (the "app"), operated by DefineYou ("we", "us"). By using the app, you agree to these terms.

1. What MongChi is

MongChi is an AI-generated entertainment app. You upload a photo of your real pet, and we use AI image generation to create a stylized pixel-art companion inspired by that photo. You then care for that companion through in-app activities (feeding, play, garden decoration, chat, and similar features).

MongChi's companion and its chat responses are AI-generated entertainment, not your real pet, not a substitute for your real pet, and not a form of consciousness, memory, or awareness. Chat responses are generated by a language model shaped by the profile you set up (name, personality tags, talking style) and are labeled as AI-generated in the app. Nothing your companion "says" reflects your actual pet's thoughts, feelings, or medical condition, and nothing in the app should be treated as pet-care, veterinary, or medical advice.

2. Eligibility

MongChi is not directed at and should not be used by children under 13 (or the equivalent minimum age in your region). If you are under the age of majority in your jurisdiction, you should only use MongChi with the involvement of a parent or guardian.

3. Your photo and content

You confirm that any photo you upload is one you have the right to use (for example, a photo of your own pet, or one you otherwise have permission to use), and that it does not depict people, third parties' pets without permission, or content that violates these terms. See our Privacy Policy for exactly how your photo is processed, sent to our AI provider, and then automatically deleted after your avatar is generated.

We reserve the right to decline to generate an avatar from a photo that fails an automated safety check, and to remove generated content that violates these terms.

4. Credits and in-app purchases

Some features (additional avatar generations, expression states, or other premium content) may require in-app credits, obtained either through normal in-app progress or through in-app purchases via Apple's App Store or Google Play, where offered.

• Basic care stays free. Everyday care actions that keep your companion healthy and happy do not require payment.
• Paid value must be additive. Paid credits and items are meant to add expression, variety, or convenience — not to be a workaround for problems on our end. If a generation fails due to a system error, a failed safety/quality check, or another fault on our side, that attempt should not consume your paid credit; contact support (see §8) if you believe a paid credit was consumed unfairly.
• Refunds are handled according to the policy of the store you purchased through (Apple App Store or Google Play), since all payment processing happens through those platforms, not directly through us. We do not have access to your payment card details.
• No real-world value. In-app credits and items have no cash value, cannot be exchanged for money, and cannot be transferred between users or accounts.

5. Acceptable use

You agree not to:

• Upload photos containing people (especially minors), explicit or graphic content, hate symbols, or anything illegal;
• Attempt to circumvent generation limits, safety checks, or rate limits through automated means or by abusing the anonymous session mechanism;
• Use the app to generate or extract content for purposes other than your own personal, non-commercial enjoyment of the app;
• Reverse-engineer, scrape, or interfere with the app's backend services;
• Use the AI chat feature to attempt to extract system prompts, jailbreak the model, or generate content that violates OpenAI's usage policies.

We may suspend or restrict access for accounts (sessions) that violate these terms.

6. No account portability

Because MongChi does not use traditional accounts, your session and local game data are tied to your device. Uninstalling the app, clearing app storage, or switching devices without an export/backup feature may result in permanent loss of your companion's local progress, memories, and credits that were stored only on that device. We are not liable for data loss resulting from device changes, app deletion, or local storage clearing.

7. Disclaimers and limitation of liability

MongChi is provided "as is" and "as available." AI-generated content (avatars and chat) may occasionally be inaccurate, low-quality, or fail to generate; we run automated safety and quality checks but cannot guarantee perfect results every time.

To the maximum extent permitted by law, we disclaim all warranties, express or implied, and we are not liable for indirect, incidental, or consequential damages arising from your use of the app, including loss of local game data. Nothing in this section limits liability that cannot be limited under applicable law.

9. Changes to these terms

We may update these terms as the app changes. We will update the "Last updated" date above when we do, and material changes will be reflected here before they take effect. Continuing to use the app after changes take effect means you accept the updated terms.

10. Governing law

These terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law principles.
